Deputy Prime Minister and Minister of Agriculture Askar Myrzakhmetov elaborated on the proposed measures to control the rational use of agricultural land leased to Kazakhstanis.

"A standard form for land lease contracts has been approved with the purpose of establishing uniform requirements for the fulfillment of obligations on the rational use of agricultural land,” – Askar Myrzakhmetov said addressing the Majilis deputies on the draft law "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Regulation of Land Relations ".

The standard lease agreement bolsters tenant responsibilities in using land and their accountability. Thus, the contract will contain the obligations and intentions proposed by the tenant in the tender offer. Failure to comply with the terms of the lease agreement will be grounds for its termination in accordance with the procedure established by law.

“For the purposes of strengthening state control over the use and protection of lands, the bill provides for the vesting of district executive bodies with competence to implement state control over the rational use of agricultural lands. In order to avoid giving large areas of agricultural land to a single tenant, the bill establishes a maximum size of agricultural land that can be leased to Kazakhstanis within administrative districts, cities of each region by land types. The size will be approved by the Government on the proposal of local representative and executive bodies,” – the Minister said.

At the same time, according to him, it is not allowed within the Republic to provide land in sizes exceeding the maximum size to a single tenant. To determine this maximum size of agricultural land, the Ministry of Agriculture has developed an appropriate methodology based on scientifically-based approaches. "They take into account the natural and agricultural zones and the leading specialization of each administrative district, the rural population's livelihoods and production resources and other factors," – he added.

According to the Ministry of Agriculture, the number of entities in the Republic, the area of ​​which exceeds more than 25 thousand hectares, is 301 (of them 225 in grain regions): from 25 to 50 thousand hectares - 232 entities, from 50 to 70 thousand hectares - 32, over 70 thousand hectares - 37.

Askar Myrzakhmetov also explained the arrangements for the use of land in the border strip and the zone, provided for in the new bill.

"The bill prohibits the provision of land plots located in the border strip and the border zone to foreigners, stateless persons, citizens of the Republic of Kazakhstan that are married to foreigners or stateless persons, foreign legal entities and legal entities of the Republic of Kazakhstan with foreign participation. Land plots of agricultural purpose, located within the border strip of the state border, are not up for ownership and land use,” – the Minister said.

He stressed that in these territories it is allowed to use agricultural land for the needs of the local population, for example, grazing and haymaking.

As previously reported, while retaining the lease of agricultural land to Kazakhstanis, the bill provides for the establishment of a separate procedure for the provision of agricultural land on a competitive basis. According to the specified order, land provision will be carried out according to the Akimat-approved list of lands put up for tendering, coordinated with public councils and non-governmental organizations.
