Draft law "On ratification of the Convention on Civil Procedure"has been approved at the plenary session of the Majilis.

"The Convention establishes a simplified procedure for interaction between the competent authorities of the member states and the diplomatic missions on service of judicial and extrajudicial documents, issues from acts of civil status, implementation of judicial commissions, as well as provision of free legal assistance," Minister of Justice Berik Imashev said presenting the bill.

Minister noted that the legislation in the field of free legal aid provides for the right to receive state guaranteed qualified legal assistance to all persons, regardless of their nationality, subject to established procedures.

Further, B.Imashev said that the Convention provides for the possibility of failure of the party to fulfill the request for legal assistance in cases where implemetation of the request for legal assistance may prejudice sovereignty, security, public order or the requested assistance is not within the powers of the competent authorities. At the same time, the Convention does not prevent the member states to agree on bilateral cooperation.The Convention includes 48 states. Participation in the Convention will allow Kazakhstan to cooperate with member countries of the Convention, with which there are no bilateral treaties in the field of civil procedure. Convention was adopted on March 1, 1954 in the framework of the Hague Conference on Private International Law.
